As I sit here this rainy Monday morning reading case law I found something of interest that I'd like to share. In this case between Deng and Henry Feng Lawyers Ltd, the Employment Relations Authority highlights the importance of complying with formal settlement agreements that are signed as full final and binding by a mediator.
Eleanor Robinson, Employment Relations Authority Member, says the following regarding compliance:
"Henry Feng Lawyers Ltd is advised that if it does not observe or comply with this Compliance Order the Employment Relations Court may do 1 or more of the following pursuant to s 140 of the Act:
(c) order that the person in default be sentenced to imprisonment for a term not exceeding 3 months;
(d) order that the person in default be fined a sum not exceeding $40,000;
(e) order that the property of the person in default be sequested".
